Without a will, your estate will not necessarily go to whom you wish, yet research indicates that two-thirds of adults in the UK have not made a will. You are not married to your partner but have children. All of your estate will pass to your children and your partner may have to make a formal legal claim against the estate for financial support.

When someone dies, it is usually necessary to apply to the Court for a Grant of Probate in order to deal with (administer) his or her estate and distribute it to the beneficiaries named in the will. Applying for a Grant of Probate need not be particularly difficult, although if you are unfamiliar with the forms or tired after being out at work all day, it can seem quite daunting.

What happens if you are no longer able to deal with your financial affairs or make decisions about your care due to mental or physical incapacity? Without a Lasting Power of Attorney (LPA) in place, a relative or friend will have to apply to the Court of Protection for a Deputyship Order.
However, not only can this take quite some time, during which no one is able to look after your affairs, but it costs far more than LPAs (the application fee is 400 instead of 82 for an LPA).In addition, your Deputy has to keep detailed accounts and send reports to the Office of the Public Guardian each year and there is also an annual supervision fee.
