Lasting Powers of Attorney

A Lasting Power of Attorney (LPA) is a legal document that gives a third party the authority to deal with your affairs if you become unable to do so for reasons such as loss of mental capacity, illness or accident. You can only create a Lasting Power of Attorney if you still retain the necessary mental capacity to do so.
Court of Protection

If a loved one is unable to make decisions due to a lack of mental capacity and they never had a Lasting Power of Attorney in place you will need to apply to the Court of Protection to become a 'deputy.' The Court of Protection is the judicial body responsible for deciding whether someone has the mental capacity to make decisions and in the absence of such capacity to assign Deputies to make those decisions.
