Careless Driving
Report
Careless driving can cover a wide range of motoring mishaps. In this section you will find everything you need to know about careless driving in Scotland. The offence of careless and inconsiderate driving is contained within section 3 of the Road Traffic Act 1988.

It provides that: "If a person drives a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration for other persons using the road or place, he is guilty of an offence."
Dangerous Driving
Report
Dangerous driving in Scotland is a serious charge. Upon conviction dangerous driving carries mandatory disqualification from driving for a minimum 12 month period and until you pass an extended driving test. A fine of up to 10,000 and/or a custodial sentence of up to 6 months may be imposed. In cases involving a jury, a prison sentence of up to two years can be imposed.
Drink / Drug Driving
Report
There is a public perception that drink driving prosecutions are open-and-shut cases for the Crown: this is not so. From malfunctioning intoximeters in breath cases to defective forensic reports in blood analysis cases, it is important to remember that it is for the Crown to prove every case beyond a reasonable doubt.
Driving Without Insurance
Report
The cases we see rarely involve a deliberate attempt to circumvent the insurance obligations but mostly fall into the category of inadvertence on the part of the driver or indeed where a third party has stated that the appropriate level of insurance cover is in place. Complexities often arise in relation why the insurance cover was lacking.
